Please read these Terms of Service ("Terms") carefully before using the ORA Furniture website or purchasing any products or services from us. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to any portion of these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and ORA Furniture, a business operating at 305 McConnell Ave, Cornwall ON K6H 4L4, Canada.
Acceptance of Terms
By using our website, visiting our showroom, placing an order, or engaging with our services in any capacity, you confirm that you:
- Are at least 18 years of age or have the legal capacity to enter into a binding agreement
- Have read and understood these Terms in their entirety
- Agree to be bound by these Terms and any policies referenced herein, including our Privacy Policy
- Acknowledge that these Terms may be updated periodically, and continued use constitutes acceptance of revisions
Products & Services
ORA Furniture sells premium handcrafted furniture for residential use through our website and Cornwall showroom. Our offerings include in-stock items, made-to-order pieces, custom-dimension furniture and fully bespoke commissions.
- All product descriptions, dimensions and images on our website are provided in good faith and are as accurate as reasonably possible. Minor variations in colour, grain pattern and texture are inherent to natural materials and are not considered defects.
- Product availability is subject to change without notice. In the event that an ordered item becomes unavailable, we will contact you promptly to discuss alternatives, adjusted timelines or a full refund.
- Custom and bespoke orders are produced specifically to your specifications and cannot be cancelled once production has commenced (see Ordering & Payment and Returns & Cancellations below).
- We reserve the right to discontinue any product or collection at any time without prior notice.
Ordering & Payment
All orders placed through our website or showroom are subject to acceptance by ORA Furniture. An order confirmation email does not constitute final acceptance; acceptance is confirmed when your order enters production or ships.
- Payment: Full payment or the required deposit is due at the time of order placement. We accept major credit cards, debit and approved financing options. All transactions are processed in Canadian dollars (CAD).
- Deposits: Custom and bespoke orders require a non-refundable deposit of 50% of the total order value at time of placement. The balance is due 7 days prior to delivery.
- Pricing: All prices displayed include applicable taxes unless otherwise stated. Prices are subject to change without notice. The price confirmed at checkout is the price that applies to your order.
- Order modifications: Requests to modify an order must be made within 48 hours of placement. Once production commences, modifications may not be possible and any resulting costs will be the customer's responsibility.
Delivery
Delivery is subject to the terms outlined on our Shipping & Delivery page, which is incorporated into these Terms by reference. Key provisions include:
- Complimentary white-glove delivery and in-home assembly are included with every ORA order Canada-wide.
- Lead times are estimates and may vary. ORA Furniture is not liable for delays beyond our reasonable control, including supply chain disruptions, extreme weather events or carrier issues.
- You are responsible for ensuring that the delivery address is accessible and that doorways, hallways and elevators can accommodate the ordered pieces. We are not responsible for items that cannot be delivered due to access limitations.
- Delivery will be attempted at the scheduled time. If you are unavailable at the confirmed delivery window without prior notice, a redelivery fee may apply.
Returns & Cancellations
Returns are subject to the terms outlined on our Returns & Refunds page, which is incorporated by reference. Key provisions include:
- In-stock items: May be returned within 30 days of delivery for a full refund, subject to items being in original, undamaged condition. Complimentary pickup is provided.
- Made-to-order items: May be cancelled within 48 hours of order placement for a full refund. After 48 hours, the 50% deposit is non-refundable.
- Custom and bespoke orders: Are non-cancellable and non-returnable once production has commenced, as they are manufactured to your unique specifications.
- Damaged deliveries: Must be reported at the time of delivery and documented in writing. Claims made after the delivery team departs may not be accepted.
Warranty
Every ORA Furniture piece is backed by our 5-Year Structural Warranty, the full terms of which are available on our Warranty page and incorporated into these Terms. The warranty covers manufacturing defects in frame, springs, foam, fabric, legs and hardware. It does not cover normal wear, accidental damage or commercial use.
Warranty claims must be submitted in writing to hello@orafurniture.ca with the original order number and photographic evidence of the defect. ORA Furniture's sole obligation under the warranty is to repair or replace the defective component at our discretion.
Limitation of Liability
To the maximum extent permitted by applicable Canadian law, ORA Furniture's liability for any claim arising from these Terms, a purchase, or use of our website shall be limited to the amount paid for the specific product giving rise to the claim.
- ORA Furniture is not liable for indirect, incidental, consequential, punitive or special damages of any kind.
- We do not warrant that our website will be uninterrupted, error-free or free of viruses or malicious code.
- We are not responsible for loss or damage arising from reliance on information provided on our website that contains errors or omissions.
- Nothing in these Terms limits or excludes liability that cannot be excluded under applicable Canadian consumer protection law.
Our website and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, except as specifically stated herein.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the applicable federal laws of Canada, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of ORA Furniture's products or services shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
Where permitted by law, disputes may first be referred to non-binding mediation in Cornwall, Ontario before proceeding to litigation. ORA Furniture will always attempt to resolve disputes amicably and in good faith.
